What you can expect from Formpey, what we expect from you, and where our responsibility ends — particularly around money.

These terms are between [legalName — not set, see lib/legal.ts](“Formpey”, “we”) and you. They apply whether you build forms with us or simply fill one in.
By using Formpey you accept them. If you do not, please do not use the service.
2. Your account
- You need an account to publish a form. You can build one without an account, but publishing requires signing in.
- You are responsible for what happens under your account, and for keeping access to your email secure — that is how you sign in.
- You must be old enough to enter a contract where you live.
- One person or organisation per account. Do not share credentials.
3. Your forms and your responses
Your forms and the responses they collect are yours. We claim no ownership over them and we do not use them for any purpose other than running the service for you.
You are responsible for what you collect. If you ask respondents for personal information, you are the one who owes them a lawful basis for it, a way to have it corrected or deleted, and honesty about what it is for. See privacy for how that responsibility divides between us.
4. Payments — the important part
Formpey is not a payment processor and is never a party to a payment made through a form. When a respondent pays, the money moves directly from them to the form’s owner, into that owner’s own Razorpay account. We do not hold it, route it, or take a commission from it.
Which means, concretely:
- The organiser is the seller. They owe the respondent whatever the form promised — the ticket, the workshop place, the goods.
- The organiser is responsible for refunds, for tax on what they collect, and for any invoice a respondent needs.
- We cannot refund, reverse, or release a payment, because we never had it.
- Disputes about what was paid for are between the respondent and the organiser. Razorpay's own terms govern the payment itself.
If you collect payments through Formpey, you confirm that you are legally entitled to sell what you are selling and that your Razorpay account is yours.
5. What you may not use Formpey for
- Anything unlawful where you or your respondents are.
- Collecting payments for goods or services you cannot or will not provide.
- Phishing, impersonating another person or organisation, or collecting credentials.
- Harassment, or collecting information about someone without a lawful basis.
- Automated abuse of the service — scraping, load testing without asking, or circumventing rate limits.
We may suspend or remove a form that breaches this, and every published form carries a way to report it. We would rather ask you about it first, and generally will, unless the harm is immediate.
6. Availability
We work to keep Formpey running and we do not promise it always will be. There is no uptime guarantee on any plan. We depend on other services — hosting, database, payment gateway — and an outage in one of those is an outage here.
A form that is live is served from cache and stays readable through brief interruptions, but submissions and payments need our servers.
7. Liability
Formpey is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss — lost revenue, lost opportunity, or the consequences of a form not being available when you needed it.
Where liability cannot be excluded, it is limited to what you have paid us in the twelve months before the claim. For a Free account that is nothing, which is worth being plain about rather than burying.
Nothing here limits liability for fraud, or for anything that cannot lawfully be limited.
8. Ending it
You can stop using Formpey whenever you like, and delete your account from your settings. Deleting your account deletes your forms and every response to them, immediately and permanently — export anything you need first.
We may close an account that breaches these terms. If we do, we will tell you why at the email on the account.
9. Changes
We may update these terms. If a change materially affects you we will email account holders before it takes effect. Continuing to use Formpey after that means accepting the new version.
10. Governing law
These terms are governed by the laws of India, and the courts at [jurisdiction — not set, see lib/legal.ts] have exclusive jurisdiction.
